🗞️ Federal Green Light: Idaho Farm Bureau Clears Path for New Group Health Plan
The U.S. Department of Labor has determined that a proposed group health plan for employees of Idaho Farm Bureau Federation members qualifies as a federally protected benefit plan under ERISA, allowing the federation to move forward with establishing coverage.

The opinion allows the IFBF to rely on that guidance as it moves forward with establishing the plan for workers employed by its roughly 10,770 member operations across the state.
The IFBF, a nonprofit federation of 39 county farm bureaus operating since 1942, sought the opinion after proposing to create a fully insured group health plan in partnership with Blue Cross of Idaho. To qualify under ERISA's definition of a "bona fide group or association of employers," the federation had to demonstrate that its purpose predated and extended beyond the provision of health benefits. The Labor Department found that the IFBF's long history of agricultural advocacy, cooperative marketing, scholarship programs, and legislative representation satisfied that requirement.
Participation in the plan will be restricted to Regular Members actively engaged in agricultural production in Idaho — including farmers, ranchers, and tenants and landlords of agricultural land — who employ at least two full-time workers. Each participating employer must also join an employer-controlled consortium that will govern the plan's administration through an elected Benefits Committee, which will operate independently of the IFBF itself. The Labor Department noted that while the plan meets the formal criteria for ERISA coverage in form, whether participating employers actually exercise meaningful control in practice remains a factual determination beyond the scope of an advisory opinion.
The opinion also confirms the plan constitutes a Multiple Employer Welfare Arrangement under ERISA section 3(40), a classification that subjects it to additional federal and state oversight requirements. The ruling comes as access to affordable employer-sponsored coverage remains a persistent challenge for small agricultural operations. Fourteen states have now authorized some form of farm bureau health plans, and the IFBF's structure under federal ERISA could serve as a reference point for similar agricultural associations in other states exploring comparable arrangements for their members' employees.
